1. Acceptance of Terms
These Terms of Service ("Terms") constitute a binding agreement between you ("Customer," "you," or "your") and Tualatin Valley Short Load, operating as Short Load PNW ("Company," "we," "us," or "our"). By placing an order, scheduling a delivery, or accepting concrete from our fleet, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.
If you are placing an order on behalf of a business, government agency, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.
2. Scope of Services
Short Load PNW provides volumetric concrete batching and delivery services throughout the Pacific Northwest, operating primarily along the I-5 corridor. Our fleet mixes concrete on-site using mobile volumetric batching equipment, delivering fresh concrete to commercial, municipal, DOT, and residential pour sites. We supply concrete materials and delivery services only; we do not provide finishing, pumping, forming, or other flatwork services unless separately contracted in writing.
3. Ordering & Scheduling
All orders are subject to fleet availability and scheduling confirmation from our dispatch team. An order is considered confirmed only when you receive verbal or written acknowledgment from a Short Load PNW dispatcher. We make every reasonable effort to meet confirmed delivery windows; however, delivery times are estimates and may be affected by traffic, weather, prior job overruns, or other factors outside our control.
Customers must provide accurate project details at the time of ordering, including mix design, estimated yardage, site address, and any known site access limitations. Inaccurate information that results in wasted material, additional trips, or scheduling disruptions may incur additional charges.
4. Minimum Order Requirements
Residential orders are subject to a strict 2-yard minimum. All residential deliveries will be billed for no fewer than 2.0 cubic yards of material regardless of the actual volume poured. This minimum reflects the fixed operational costs of mobilizing a volumetric truck and operator.
Minimum: 2.0 yd³
Commercial and DOT project minimums are quoted on a per-project basis. Contact our dispatch team for commercial minimum requirements specific to your project scope and location.
5. Pricing & Payment
Residential pricing is based on a per-cubic-yard material rate plus a flat delivery fee as published on our website. Full-truck orders of 10 or more cubic yards qualify for a waived delivery fee. Commercial and DOT pricing is quoted individually based on mix design, volume, location, and scheduling requirements.
Surcharges may apply for after-hours delivery (5:00 PM–6:00 AM), Saturday delivery, Sunday delivery, and deliveries to out-of-area locations. All applicable surcharges will be disclosed at the time of order confirmation.
Payment is due in full upon completion of the pour unless credit terms have been established in writing. We accept major credit cards, checks, and ACH transfers. A service charge of 1.5% per month (18% per annum) will be applied to past-due balances. Customer is responsible for all collection costs, including reasonable attorney fees, in the event of non-payment.
6. Delivery & Site Access
The Customer is solely responsible for providing safe, legal, and adequate truck access to the pour site. This includes confirming that the route, entry point, and pour area can physically accommodate our volumetric equipment (approximately 40 feet long, 35,000+ lbs loaded). The Customer must ensure that all necessary permits, right-of-way clearances, and traffic control measures are in place prior to the scheduled delivery.
The Customer assumes all liability for property damage — including but not limited to damage to driveways, sidewalks, curbs, landscaping, irrigation systems, underground utilities, and any private or public property — once the truck crosses the curb line at the Customer's direction.
If our driver determines on arrival that site conditions are unsafe or that the truck cannot access the pour area without risk of damage or injury, the driver may decline to proceed. In such cases, the delivery may be rescheduled and a No-Pour fee may apply (see Section 8).
Customers must have all formwork, reinforcement, grade preparation, and crew ready at the time of the scheduled delivery. We are not responsible for delays caused by incomplete site preparation.
7. Standby Time
Standby time is billed at $5.00 per minute after a 10-minute-per-yard grace period. The grace period is calculated based on the total yards ordered (e.g., a 3-yard order includes 30 minutes of grace time). The standby clock begins when the truck is positioned and ready to pour.
Standby charges compensate for the loss of fleet availability that occurs when a truck is held on-site beyond the expected pour window. Our drivers will notify you before standby billing begins. Standby charges are calculated in one-minute increments and will be added to your invoice.
8. Cancellation & No-Pour Policy
A strict $200.00 penalty applies to all No-Pour events and on-site cancellations. A "No Pour" is defined as any confirmed delivery in which the truck arrives at the site and the Customer elects not to proceed with the pour, or in which conditions on-site prevent the pour from taking place.
Cancellations made more than 24 hours before the scheduled delivery window will not incur a penalty. Cancellations made within 24 hours of the scheduled delivery may be subject to the $200 No-Pour fee at the Company's discretion, depending on whether the truck has already been dispatched or materials loaded.
If a pour is partially completed and the Customer requests the truck to leave the site before the full ordered volume has been delivered, the Customer will be billed for the greater of (a) the actual volume delivered or (b) the originally confirmed order volume.
9. Site Responsibility & Liability
The Customer shall maintain a safe working environment for our personnel and equipment at all times. The Customer is responsible for:
- Identifying and marking all underground utilities, septic systems, and other subsurface hazards prior to delivery.
- Providing stable, level ground capable of supporting the weight of a fully loaded volumetric truck.
- Ensuring that overhead clearance (power lines, tree branches, structures) is adequate for truck access and operation.
- Obtaining all required municipal, county, or state permits for the concrete work being performed.
- Providing a safe washout area for post-pour equipment cleaning, in compliance with local environmental regulations.
Short Load PNW shall not be held liable for damage to subsurface features, underground utilities, or any structures that the Customer failed to identify prior to delivery. Our liability for any claim arising from our services shall not exceed the invoiced amount for the specific delivery in question.
10. Product Specifications & Quality
All concrete is batched according to industry-standard mix designs and, where applicable, in accordance with ODOT, WSDOT, or other DOT specifications. Our standard residential mix is a 4,000 PSI design unless otherwise specified at the time of ordering.
Volumetric batching allows for real-time mix adjustments at the point of pour. Any changes to the confirmed mix design requested on-site must be approved by our operator and may affect pricing. We are not responsible for performance issues arising from Customer-directed changes to mix ratios, water content, or admixture dosages that deviate from the confirmed design.
Concrete testing (slump tests, cylinder samples, air content tests) is the Customer's responsibility unless separately arranged in writing. We will cooperate with third-party testing services present on-site.
11. Warranty & Limitations
We warrant that all concrete delivered will conform to the confirmed mix design specifications at the time of discharge. This warranty extends to the materials and proportioning only. We make no warranty, express or implied, regarding the finished result of the Customer's concrete work, which is affected by factors entirely outside our control — including but not limited to site preparation, forming, finishing technique, curing practices, weather exposure, and subgrade conditions.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHORT LOAD PNW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. In no event shall the Company be liable for indirect, incidental, consequential, or punitive damages of any kind.
12. Indemnification
The Customer agrees to indemnify, defend, and hold harmless Short Load PNW, its officers, employees, agents, and subcontractors from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising out of or related to: (a) the Customer's breach of these Terms; (b) the Customer's negligence or willful misconduct; (c) the Customer's failure to provide safe site access or accurate site information; or (d) any property damage occurring after the truck enters the Customer's property at the Customer's direction.
13. Force Majeure
Short Load PNW shall not be liable for delays or failure to perform resulting from circumstances beyond our reasonable control, including but not limited to: severe weather, natural disasters, road closures, government orders, labor disputes, supply chain disruptions, equipment failure, pandemics, or acts of God. In the event of a force majeure occurrence, we will make reasonable efforts to notify the Customer promptly and reschedule the delivery at the earliest available opportunity.
14. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to conflict-of-law principles. Any dispute arising under or relating to these Terms that cannot be resolved through good-faith negotiation shall be submitted to binding arbitration in Washington County, Oregon, under the rules of the American Arbitration Association. The prevailing party in any arbitration or court proceeding shall be entitled to recover its reasonable attorney fees and costs.
15. Amendments
Short Load PNW reserves the right to update or modify these Terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our services following any modification constitutes acceptance of the revised Terms. For commercial accounts with standing contracts, amendments will be communicated directly and shall not take effect until the start of the next billing period.
